江蘇省高價(jià)值專利培育示范中心，是指經(jīng)江蘇省知識(shí)產(chǎn)權(quán)局批準(zhǔn)立項(xiàng)為省高價(jià)值專利培育計(jì)劃項(xiàng)目后，企業(yè)或者高等院校、科研機(jī)構(gòu)牽頭建設(shè)，以培育高價(jià)值專利、實(shí)現(xiàn)關(guān)鍵技術(shù)自主可控、引領(lǐng)帶動(dòng)相關(guān)產(chǎn)業(yè)創(chuàng)新發(fā)展為主要目標(biāo)的機(jī)構(gòu)。

江蘇省高價(jià)值專利培育示范中心申報(bào)條件

在江蘇省注冊(cè)的具有獨(dú)立法人資格的企業(yè)或者省內(nèi)高等院校、科研院所等科研機(jī)構(gòu)，符合申報(bào)條件的，可以單獨(dú)或者牽頭申報(bào)省高價(jià)值專利培育計(jì)劃項(xiàng)目并組建示范中心。鼓勵(lì)上述單位與產(chǎn)業(yè)鏈上下游企業(yè)、相關(guān)研發(fā)機(jī)構(gòu)、知識(shí)產(chǎn)權(quán)服務(wù)機(jī)構(gòu)聯(lián)合申報(bào)。

申報(bào)主體是企業(yè)的，應(yīng)當(dāng)符合下列基本條件：

（一）在相關(guān)技術(shù)領(lǐng)域研發(fā)水平處于行業(yè)領(lǐng)先地位，屬于行業(yè)龍頭或領(lǐng)軍企業(yè)，正在承擔(dān)國(guó)家或省部級(jí)重大科技項(xiàng)目，或者正在開展關(guān)鍵技術(shù)研發(fā)，已取得一定成果；

（二）研發(fā)投入穩(wěn)定，經(jīng)營(yíng)狀況良好；

（三）知識(shí)產(chǎn)權(quán)管理制度健全，知識(shí)產(chǎn)權(quán)基礎(chǔ)好；

（四）無(wú)嚴(yán)重失信行為。

申報(bào)主體是高?；蛘呖蒲袡C(jī)構(gòu)的，應(yīng)當(dāng)符合下列基本條件：

（一）在相關(guān)技術(shù)領(lǐng)域研發(fā)水平處于國(guó)際領(lǐng)先，擁有與該領(lǐng)域相關(guān)的國(guó)家或省重點(diǎn)實(shí)驗(yàn)室、工程實(shí)驗(yàn)室或工程（技術(shù)）研究中心等研發(fā)平臺(tái)，正在承擔(dān)國(guó)家或省部級(jí)重大科技項(xiàng)目，或者正在開展關(guān)鍵技術(shù)研發(fā)，已建立產(chǎn)學(xué)研合作機(jī)制，并取得一定成果；

（二）研發(fā)投入穩(wěn)定；

（三）知識(shí)產(chǎn)權(quán)管理制度健全，知識(shí)產(chǎn)權(quán)基礎(chǔ)好；

（四）無(wú)嚴(yán)重學(xué)術(shù)不端等失信行為。

設(shè)區(qū)市、縣（市、區(qū)）知識(shí)產(chǎn)權(quán)局按照申報(bào)通知的要求，組織本轄區(qū)內(nèi)符合條件的單位進(jìn)行申報(bào)，逐級(jí)審核推薦。江蘇省知識(shí)產(chǎn)權(quán)局組織專家評(píng)審，擇優(yōu)立項(xiàng)。

江蘇省高價(jià)值專利培育示范中心申報(bào)流程

建設(shè)期驗(yàn)收通過(guò)的示范中心，可以掛牌進(jìn)入運(yùn)行期，每3年為一個(gè)運(yùn)行周期。運(yùn)行期的主要任務(wù)是：

（一）優(yōu)化高價(jià)值專利培育體系。將示范中心作為單位內(nèi)設(shè)部門或機(jī)構(gòu)掛牌運(yùn)行，設(shè)立獨(dú)立辦公場(chǎng)所，配備專職工作人員，強(qiáng)化軟硬件設(shè)施保障，加大知識(shí)產(chǎn)權(quán)經(jīng)費(fèi)投入。完善管理和運(yùn)行制度，制定高價(jià)值專利培育年度計(jì)劃。建立管理高層例會(huì)制度，定期聽取高價(jià)值專利培育工作報(bào)告，研究審議重大事項(xiàng)。推動(dòng)高價(jià)值專利培育機(jī)制全面覆蓋企業(yè)、科研院所或高校（二級(jí)學(xué)院）的創(chuàng)新體系。

（二）運(yùn)用專利信息開展關(guān)鍵技術(shù)攻關(guān)。引入高端知識(shí)產(chǎn)權(quán)服務(wù)資源，利用專利數(shù)據(jù)和產(chǎn)業(yè)數(shù)據(jù)開展專利導(dǎo)航，研判產(chǎn)業(yè)專利布局和競(jìng)爭(zhēng)格局，預(yù)測(cè)產(chǎn)業(yè)和技術(shù)發(fā)展趨勢(shì)。梳理影響產(chǎn)業(yè)發(fā)展的“牽鼻子”“卡脖子”技術(shù)，確立關(guān)鍵技術(shù)的研發(fā)策略和路徑。運(yùn)用專利等信息提高研發(fā)效能，突破一批關(guān)鍵技術(shù)。

（三）開展高質(zhì)量專利申請(qǐng)和布局。圍繞創(chuàng)新成果研究確定專利申請(qǐng)和布局策略。落實(shí)專利申請(qǐng)前置評(píng)審和專利質(zhì)量管控制度，高質(zhì)量撰寫專利申請(qǐng)文件，提高專利授權(quán)率。

（四）推動(dòng)專利轉(zhuǎn)化運(yùn)用。企業(yè)建立專利分級(jí)分類管理制度，開展專利價(jià)值評(píng)估，通過(guò)自行實(shí)施、許可他人實(shí)施、轉(zhuǎn)讓等方式促進(jìn)專利轉(zhuǎn)化運(yùn)用。推動(dòng)以高價(jià)值專利為基礎(chǔ)參與制定各類標(biāo)準(zhǔn)。

（五）完善專利維權(quán)機(jī)制。明確高價(jià)值專利權(quán)利歸屬，完善專利風(fēng)險(xiǎn)研判、防控和維權(quán)機(jī)制，積極應(yīng)對(duì)專利糾紛。

（六）強(qiáng)化產(chǎn)業(yè)和區(qū)域示范帶動(dòng)作用。聯(lián)合產(chǎn)業(yè)鏈上下游企業(yè)及相關(guān)科研機(jī)構(gòu)、知識(shí)產(chǎn)權(quán)服務(wù)機(jī)構(gòu)，組建產(chǎn)業(yè)知識(shí)產(chǎn)權(quán)聯(lián)盟、行業(yè)協(xié)會(huì)或其他聯(lián)合體，探索組建專利池，共同推進(jìn)產(chǎn)業(yè)關(guān)鍵技術(shù)的專利創(chuàng)造、運(yùn)用和保護(hù)，提升產(chǎn)業(yè)整體競(jìng)爭(zhēng)力。舉辦高價(jià)值專利培育示范現(xiàn)場(chǎng)會(huì)或成果推介會(huì)，帶動(dòng)相關(guān)產(chǎn)業(yè)和區(qū)域創(chuàng)新主體提升高價(jià)值專利培育水平。

示范中心應(yīng)當(dāng)在江蘇省知識(shí)產(chǎn)權(quán)局的指導(dǎo)下，編制3年運(yùn)行規(guī)劃和年度工作計(jì)劃，明確運(yùn)行任務(wù)和績(jī)效目標(biāo)，每個(gè)運(yùn)行周期簽訂一次任務(wù)書。

江蘇省高價(jià)值專利培育示范中心申報(bào)獎(jiǎng)勵(lì)

示范中心實(shí)行優(yōu)勝劣汰、動(dòng)態(tài)調(diào)整制度。江蘇省知識(shí)產(chǎn)權(quán)局每3年對(duì)示范中心組織進(jìn)行一次績(jī)效評(píng)價(jià)。

績(jī)效評(píng)價(jià)以任務(wù)書確定的任務(wù)和目標(biāo)、實(shí)際運(yùn)行的客觀數(shù)據(jù)為主要依據(jù)，主要評(píng)價(jià)示范中心運(yùn)行管理、開展高價(jià)值專利培育、構(gòu)筑產(chǎn)業(yè)核心競(jìng)爭(zhēng)力、引領(lǐng)帶動(dòng)產(chǎn)業(yè)高質(zhì)量發(fā)展等方面的情況。

績(jī)效評(píng)價(jià)結(jié)果分為優(yōu)秀、良好、合格和不合格四個(gè)檔次，江蘇省知識(shí)產(chǎn)權(quán)局根據(jù)評(píng)價(jià)結(jié)果分別作下列處理：

（一）評(píng)價(jià)結(jié)果為優(yōu)秀、良好或者合格的，同意其進(jìn)入下一輪運(yùn)行周期，擇優(yōu)給予激勵(lì)；

（二）評(píng)價(jià)結(jié)果為不合格的，要求其限期整改，整改時(shí)限一般不超過(guò)半年；

（三）無(wú)正當(dāng)理由不參加評(píng)價(jià)、未完成評(píng)價(jià)或者整改后仍不合格的，予以摘牌，取消其示范中心稱號(hào)并予以公告。

示范中心實(shí)行年度工作報(bào)告制度，報(bào)告內(nèi)容包括：示范中心運(yùn)行總體情況、任務(wù)執(zhí)行進(jìn)度、資金使用情況、取得的成效、特色亮點(diǎn)工作、存在問(wèn)題及下一步工作計(jì)劃等。示范中心年度工作報(bào)告經(jīng)設(shè)區(qū)市知識(shí)產(chǎn)權(quán)局審核后報(bào)送江蘇省知識(shí)產(chǎn)權(quán)局。

Jiangsu Provincial High Value Patent Cultivation Demonstration Center refers to an organization that has been approved by Jiangsu Intellectual Property Office as a provincial high value patent cultivation plan project, led by enterprises or colleges and universities, and scientific research institutions, with the main goal of cultivating high value patents, achieving independent and controllable key technologies, and leading the innovation and development of related industries.

Application conditions for Jiangsu High Value Patent Cultivation Demonstration Center

Enterprises with independent legal personality registered in Jiangsu Province or scientific research institutions such as colleges and universities and scientific research institutes in the province, which meet the application conditions, can independently or take the lead in applying for provincial high-value patent cultivation plan projects and establishing demonstration centers. The above units are encouraged to jointly apply with upstream and downstream enterprises of the industrial chain, relevant R&D institutions and intellectual property service institutions.

If the applicant is an enterprise, the following basic conditions shall be met:

（1） The R&D level in the relevant technology field is in the leading position in the industry. It is a leading or leading enterprise in the industry. It is undertaking major national or provincial and ministerial science and technology projects, or is carrying out research and development of key technologies, and has achieved certain results;

（2） Stable R&D investment and good operation;

（3） Sound intellectual property management system and sound intellectual property foundation;

（4） No serious dishonesty.

If the applicant is a university or scientific research institution, the following basic conditions shall be met:

（1） The R&D level in the relevant technology field is at the international leading level. It has national or provincial key laboratories, engineering laboratories or engineering (technology) research centers and other R&D platforms related to this field, is undertaking major national or provincial science and technology projects, or is carrying out key technology research and development, has established an industry university research cooperation mechanism, and has achieved certain results;

（2） Stable R&D investment;

（3） Sound intellectual property management system and sound intellectual property foundation;

（4） No serious academic misconduct and other dishonest behaviors.

The intellectual property bureaus of cities divided into districts and counties (cities and districts) shall organize qualified units within their respective jurisdictions to make applications according to the requirements of the application notice, and review and recommend them level by level. Jiangsu Provincial Intellectual Property Office organizes experts to review and select the best to establish the project.

Application Process of Jiangsu High Value Patent Cultivation Demonstration Center

The demonstration center that has passed the acceptance during the construction period can be listed into the operation period, with an operation cycle of every three years. The main tasks during the operation period are:

（1） Optimize the high-value patent cultivation system. The demonstration center will be put into operation as an internal department or institution of the unit, set up an independent office, equipped with full-time staff, strengthen the guarantee of software and hardware facilities, and increase the investment of intellectual property funds. Improve the management and operation system, and formulate the annual plan for high-value patent cultivation. Establish a regular meeting system for senior management, regularly listen to reports on high-value patent cultivation, and study and review major issues. Promote the innovation system in which the high-value patent cultivation mechanism comprehensively covers enterprises, research institutes or universities (secondary colleges).

（2） Use patent information to tackle key technologies. Introduce high-end intellectual property service resources, use patent data and industrial data to carry out patent navigation, study and judge industrial patent layout and competition pattern, and predict industrial and technological development trends. Sort out the "leading" and "choking" technologies that affect industrial development, and establish the R&D strategy and path of key technologies. Use patent and other information to improve R&D efficiency and break through a number of key technologies.

（3） Carry out high-quality patent application and layout. Determine the patent application and layout strategy based on the research of innovative achievements. We implemented the system of patent application pre review and patent quality control, wrote patent application documents with high quality, and improved the patent licensing rate.

（4） Promote the transformation and application of patents. The enterprise shall establish a patent classification management system, carry out patent value evaluation, and promote the transformation and application of patents through self implementation, licensing others to implement, transfer, etc. Promote participation in the formulation of various standards based on high-value patents.

（5） We will improve the patent protection mechanism. Clarify the ownership of high-value patent rights, improve the mechanism of patent risk research and judgment, prevention and control and rights protection, and actively respond to patent disputes.

（6） Strengthen the leading role of industrial and regional demonstration. Cooperate with upstream and downstream enterprises of the industrial chain and relevant scientific research institutions, intellectual property service institutions, establish industrial intellectual property alliances, industry associations or other consortia, explore the establishment of patent pools, jointly promote the creation, application and protection of patents for key industrial technologies, and enhance the overall competitiveness of the industry. Hold high-value patent cultivation demonstration on-site meeting or achievement promotion meeting to drive relevant industries and regional innovation entities to improve the level of high-value patent cultivation.

The demonstration center shall, under the guidance of Jiangsu Intellectual Property Office, prepare a three-year operation plan and annual work plan, define the operation tasks and performance objectives, and sign a task statement once per operation cycle.

Application award of Jiangsu High Value Patent Cultivation Demonstration Center

The demonstration center implements the system of survival of the fittest and dynamic adjustment. Jiangsu Intellectual Property Office conducts performance evaluation on the demonstration center every three years.

The performance evaluation is mainly based on the tasks and objectives determined in the mission statement and the objective data of actual operation. It mainly evaluates the operation management of the demonstration center, the development of high-value patents, the construction of industrial core competitiveness, and the leading and driving of high-quality industrial development.

The performance evaluation results are divided into four grades: excellent, good, qualified and unqualified. Jiangsu Intellectual Property Office will make the following treatments according to the evaluation results:

（1） If the evaluation results are excellent, good or qualified, they are agreed to enter the next round of operation cycle and will be given incentives based on their merits;

（2） If the evaluation result is unqualified, it is required to rectify within a time limit, which generally does not exceed half a year;

（3） Those who do not participate in the evaluation without proper reasons, do not complete the evaluation, or are still unqualified after rectification, shall be delisted, and the title of the demonstration center shall be canceled and announced.

The demonstration center implements an annual work report system, which includes the overall operation of the demonstration center, the progress of task implementation, the use of funds, the results achieved, featured highlights, existing problems, and the next work plan. The annual work report of the Demonstration Center shall be submitted to the Intellectual Property Office of Jiangsu Province after being reviewed by the Intellectual Property Office of the cities with districts.
